What is your (legitimate) solution for Democrats, then? The only solution I can see (not involving packing the courts) is to simply win enough elections over a significant length of time to install justices when the old ones retire. However, that would also mean winning the Senate and Presidency at once, for something like, what, 16-20 years straight? If the GOP controls either the Presidency or Senate, the Democrats cannot replace a SCOTUS member. 

 

So if one side (GOP) is willing to literally destroy all conventions to win, what can the other side do? The only solution is to do the exact same thing.

 

This all stems from the fact that the US Constitution is incredibly poorly written, in terms of structure, and allows a two-party system to completely exploit it.

The Democrats likely have this election in the bag.  As long as they don't go overboard on their legislation, they should retain a significant number of independent and Republican voters.  If you want to give the Senate and House back to the Republicans in 2022, then I'd recommend you enact policies like the GND and stricter gun control laws. 

 

Is retaining the Senate hard?  Yes.  Is it impossible?  No.  The Democrats have had complete control of the Senate for YEARS (DECADES!) in a row in the past.  Propose and enact policies that a majority of your constituents will support and you're more likely to stay in power.

RBG’s death will be the October surprise.

 

The “surprise” being that the senate will confirm a new Trump appointed justice in record time.

Republicans are low key hoping they will get some kind of Scalia bump in November from single issue SCOTUS voters that would otherwise stay home for Trump

 

I don't think even they know exactly what it would be, though, because with controlling the presidency and Senate the timing would be difficult to impossible to pull off at this point to provide a prod for Nov. 3rd.

 

But besides the obvious and constant nerve wracking over this poor little old lady's health, there have been a few rumblings that some are trying to convince Uncle Thomas to step down so he can be replaced with a gun owning Republican Federalist Society fetus that can usher the court into the 22nd century.
