Lawyers for former President Donald Trump on Monday urged a federal judge to reject the Justice Department's attempt to continue to review documents seized from Mar-a-Lago as part of its criminal investigation, saying that the materials may not be classified and that his Florida resort is secure.

So according to Maggie Haberman, Trump KNEW he lost. Isn’t that the basic problem with the January 6th case was whether or not Trump actually believed the election was stolen?

Former President Donald Trump repeatedly told aides in the days following his 2020 election loss that he would remain in the White House rather than let incoming President Joe Biden...

Haberman writes that in the immediate aftermath of the November 3 elections, Trump seemed to recognize he had lost to Biden. He asked advisers to tell him what had gone wrong. He comforted one adviser, saying, “We did our best.” Trump told junior press aides, “I thought we had it,” seemingly almost embarrassed by the outcome, according to Haberman.

Sounds like some folks got in his ear and told him what he wanted to hear and changed his mind... completely on brand. If anything he can blame THEM... Rudy, Sidney Powell etc.

Eh, the DOJ can still file an appeal, especially after Cannon makes the obviously shitty pick.

Forgot to post this ; Lawfare seems to think the appeal will be successful.  They’re usually not that partisan, and are sometimes quite contrarian, and they are *very* critical of the Cannon’s decision.

Judge Cannon has been taking a bit of a beating all week for her decision. The criticism, some of it vituperative, has contained a lot of falsehoods and a considerable dollop of conspiracy theorizing, and it has often ascribed partisan motive for the ruling.

All of which might under normal circumstances tempt our contrarian hearts to try to defend the opinion.

But Cannon’s opinion actually defies defense. It is an epic mess, one that manages to do violence to a remarkable number of distinct areas of law in an admirable economy of only 24 pages.

The opinion is likely to be short lived—and, as such, might normally not be worth significant comment. As the constitutional scholar Charles Black once wrote, while “the insignificant error, however palpable, can stand, because the convenience of settlement outweighs the discomfort of error[,] the hugely consequential error cannot stand and does not stand.” Whether this opinion will be gone in a week or will take a little longer, it will very likely not stand.

Former president Donald Trump on Thursday hinted that his supporters could engage in a protracted campaign of violence if he were to be indicted for any crimes discovered in the myriad criminal investigations into his conduct.
