That's exactly what happened. It's effectively the same situation that occurred with the travel ban: the Court overturned the administration's initial ham-fisted approach and showed them they way to implement it in a way that would pass judicial review. Anathema- Posted June 19, 2020 Share Posted June 19, 2020 The thing to keep in mind about "oh SCOTUS is just showing him how to do it legally," he has a whole team of lawyers whose job it is to do that before he does anything. Each agency has whole legal divisions whose job it is to do that. He's just too dumb and lazy to do it right and it's a huge waste of SCOTUS' time to perform basic legal counsel work for him.
