They could have created legislation sometime in the last 49 years that made it law. Congress is lazy though, and relies on the Supreme Court to legislate for them much of the time.

I follow Musk on Twitter, and one of the things he's proposed doing it getting rid of the bot accounts that are used to spam actual users. I think this is a good thing. For popular accounts/tweets, it's hard to get a tweet in edgewise because there are so many bots spamming a tweet.
