Trump judge rules machine guns are legal under the Second Amendment

Many gun-control advocates will point to US v Miller (1939) as one of the only sane rulings by the Supreme Court.  The court essentially said the only firearms that are protected are those that are used by the military.  At the time the defendant (who was deceased when the case made it to SCOTUS) was in possession of a sawed off shotgun, which the National Firearms Act had made essentially illegal (only accessible if you paid a $200 tax).  The court determined that since there was no legitimate military use for a short barreled shotgun, that the government could regulate it and not violate the 2nd amendment in doing so. 

 

I know the court really isn't treating Miller as precedent anymore, but I do find it to be an interesting case for several reasons, and it's often used by both sides of the debate to make their arguments.

Maybe I'm naive, but I feel there is a trade to be made on the NFA. Remove the parts about SBRs and some suppressors, in exchange for universal background checks and putting magazines over X capacity under a more simple NFA process. There are a lot of objectively stupid gun laws (example the import laws and the pistol brace thing) that I feel like just feed right wing "anti government/government is stupid culture". The assault weapons ban is never coming back, repealing the 2nd Amendment is never happening. Might as well trade the stupid laws for ones that would actually make a difference (barely).

Barrett .50 caliber rifles are available to purchase in most states.

I have felt for a long while that if the second amendment prevents some things from being banned then it clearly allows for all arms, no restrictions. Nuclear, chemical, biological, all of it legal. If you can buy or make a rocket, sure. Buy a fighter jet, tank, or combat drone? Absolutely. 
 

so if we can restrict anything, we can restrict almost everything.

Want to go hunting? Get up close like an adult. 

Home defense? Hit ‘em over the head.

Manage to rob a bank with one? You earned that dough.

You’re one of those NRA weird gun fetishists type? Well, it’s a smooth bore. Go nuts.
